Regulatory Roundup Impacting Federal Environmental Permitting for Port and Waterfront Projects
This regulatory roundup presentation will cover the primary recent developments and ongoing issues impacting federal environmental permitting for port and waterfront projects. The presentation will provide a high-level overview of (1) the National Environmental Policy Act (NEPA) statutory and regulatory updates, (2) Clean Water Act Waters of the U.S. jurisdictional changes and impacts on Army Corps permitting; (3) Endangered Species Act (ESA) regulatory changes and Salish Sea Nearshore Programmatic issues; and (4) environmental justice considerations. Each of these federal regulatory requirements impacts project timingand in some casesproject design.
Speaker:
Rachael Lipinski is an attorney at Van Ness Feldmans Seattle Office. Her practice focuses on complex federal permitting for port and renewable projects. Rachaels experience as an attorney for the Department of the Interior and the U.S. Coast Guard allows her to provide strategic advice and counsel in obtaining federal authorizations and completing federal consultations.
