PROGRAM:  "2023 California Employment Laws That Create New Obligations and Compliance Issues"

The California legislature created several new bills that were signed into law and impose new obligations on California employers in 2023 and beyond. Employers should take note of 5 laws that may be applicable to their operations.

1. Bereavement Leave (AB 1949): Most California employers with 5 or more employees are required to provide up to 5 days of bereavement leave for the death of the employee's family member.

2. California Family Rights Act Designated Person (AB 1041): The list of family members for whom an employee may take leave to care for will be expanded to include a designated person.

3. Pay Scale Disclosure/Pay Data Reporting Obligations (SB 1162): All employers must, upon request, provide pay scale information to a current employee for the position in which the employee is currently employed.

4. Cannabis Use and Testing (AB 2188): California employers will be prohibited from discriminating against an employee or job applicant based upon the person's use of cannabis off the job and away from the workplace.

5. California Covid-19 Supplemental Paid Sick Leave (AB 152): California's Covid-19 Supplemental Paid Sick Leave (SPSL) gives employees up to an additional 40 hours of SPSL if they or a covered family member test positive for Covid-19, but an employer may require the employee to submit a diagnostic test to prove the employee is entitled to the additional Covid-19 SPSL.

In addition, the presenters will include a segment on Owners and Contractors continued attempts to avoid indemnity limitations set forth in Civil Code ยง2872.8, and Contract pitfall language in design build projects.
