REFORMING SCOTUS BEYOND JUST COURT PACKING: -- Alex Karlin
Thursday, January 20, 2022 10:30am - 12:30pm SLO Library Community Room
In this LLCC class, Alex S. Karlin, a member of the Supreme Court Bar, a retired Federal Administrative Law Judge, and native of Washington DC, will review the November 2021 Report by Bidens Blue Ribbon Commission on Reforming the Supreme Court, and discuss whether and how the Court can be reformed.
The Supreme Court, as the final arbiter of the meaning and interpretation of all law in the United States has enormous power and impact on the lives of American citizens. At the same time SCOTUS is the least democratic branch of the federal government. Is this a problem? Can it be fixed?
In April 2021, President Biden created a commission of 36 distinguished constitutional scholars and jurists to study this problem and to recommend possible solutions and reforms. Packing the Court is just the tip of the iceberg. Other possible reforms include term limits, eliminating the shadow docket, changing the confirmation process, stripping SCOTUS of jurisdiction, and/or allowing Congress to veto Supreme Court decisions entirely.
Or perhaps the President, like Andrew Jackson, can simply ignore SCOTUS decisions? The Commission has held several public meetings, has heard testimony from 67 experts, and has received over 9000 public comments. Its report was due in November 2021.
Alex S. Karlin is a member of the Bar of the Supreme Court, a Federal Administrative Law Judge, and native of Washington DC (now happily retired in SLO).He has studied the Supreme Court for 40 years, been involved in briefing for Supreme Court, cases and has sat in on a number of oral arguments in the Supreme Court. He has given several LLCC classes on SCOTUS and these are available online at the LLCC website.
