Protection of Moral Rights in the Visual Arts
Most European nations have long recognized the concept of "moral rights" - the idea that artists have the right to control their work and that the integrity of a work of art should be protected and preserved. But what about here in the United States? The Visual Artists Rights Act of 1990 (VARA), enacted by Congress, grants limited rights to certain artists, and many states have enacted legislation giving artists a range of moral rights. But what exactly are those rights and how are they acquired? And what kinds of art are protected? Attorneys Gary Swearingen and Bob Cumbow lead a discussion of VARA and moral rights, and will answer your questions.
