PRESENTATION: Construction Claims & Forensic Analyses  What You Should Know
Construction projects, especially the larger projects, can be and often are complex endeavors to manage to towards a successful completion due to many factors. Project owners, designers, contractors and other stakeholders often have competing priorities.  Typically, contracts allow the party that is seeking compensation or schedule relief for the a scope change, usually the contractor, to submit a claim to the other party when regular change order negotiations dont appear to be leading to an amicable a mutually agreeable conclusion, and the subject of the claim is in dispute between the parties.  A claim is a formal demand seeking compensation and/or schedule relief as a result of an action or inaction that the other contracting party took or failed to take.  Even if a claim is a disputed change does not seem to be inevitable, knowing how to prepare for a claim and when the time comes will save a significant amount of time when the amount of available time is nearly seemingly non-existent.  This presentation will be a high-level discussion describing the following aspects of disputed changes on construction projects, along with what forensic claims analysts know and what they look for:
- The Definition and Common Causes of Claims in construction;
- Key aspects to preparing a Claim, including the Three Key Proofs that must be part of claim;
- Know what to do to Prepare for the possibility of a disputed change and the need to submit a Claim;
- Overview of a few Common types of Claims:
-  Directed Changes
-  Constructive Changes
-  Differing Site Conditions
-  Suspension of Work
-  Productivity Loss
-  Delay

PRESENTER:  Stephen P. Warhoe, PhD, PE, CCE, CFCC, CCM
Dr. Warhoe has 30 years of international experience as a practitioner and expert witness in the claims and dispute resolution field. His PhD is in Program and Project management, which aligns perfectly with his role in the construction claims and dispute resolution field. Steves construction forensics expertise comes from working several years in the project management, project controls, risk management, and construction management fields; primarily in the areas of manufacturing, heavy civil, transportation, and major commercial. Steve is also an accomplished claims and disputes resolution consultant, specializing as a testifying expert witness on large and complex disputes involving delay and productivity loss, with project sizes in the billions of dollars and disputed amounts also in the billions of dollars. He has worked on several domestic and international mega programs including the construction of nuclear and coal-fired power plants, oil refineries, green field airports, public school construction programs, and major transportation programs. Projects of note include the Panama Canal Expansion, Kuala Lumpur International Airport, London-Heathrow Airport, the SR 520 Floating Bridge Replacement Project and the SR-99 Viaduct Replacement.

Steve has been a member of AACE for over 30 years, and was the Associations president from 2009 to 2010. He is currently active on the Associations Technical board.

COST:
The member price for this event is $32.00 if you register before 12:00 Noon on the Monday immediately preceding the meeting; late registration is $37.00.
Non-members price is $39.00 before 12:00 Noon on the Monday immediately preceding the meeting, and $45.00 thereafter.


Please note that registration will be closed Monday, January 8th, at 8:00 pm.

A very limited of first come first served meals will be available at the door.
