Disability, Accessibility, and Liability: Whos Responsible for ADA and FHA Compliance?
This presentation was prepared to provide an analysis of the August 2012 decision by the Nevada Supreme Court that the Americans with Disabilities Act was enacted to remedy discrimination against disabled individuals and to prevent discrimination. Participants will have a better understanding of the roles of various parties to a project in determining and achieving ADA compliance; learn to consider the dissemination of information during a project and the decision-making process that flows from that; evaluate contractual allocations of this responsibility and review recent court decisions that underscore the importance of this process.

Jean Weil is one of the founding partners of Weil & Drage and has been a construction litigation specialist since 1987, representing some of the top design professional firms worldwide. In addition to her trial practice, Jean's experience includes drafting and negotiating contracts and risk management assistance for private and public works projects in California and Nevada. She continues to specialize in the representation of architects and engineers and has also represented developers, manufacturers, and contractors. She has an extremely loyal client base due to her reputation for being an aggressive, hands-on litigator, who balances the unique demands of each client and each case. Jean has focused her practice on complex civil litigation, including construction business/contracts, high exposure personal injury, governmental torts and coverage, as well as business-related civil litigation. Jean has worked in literally every aspect of construction litigation, dealing closely with clients and insurance carrier representatives. She is highly regarded for her seminars on the subject of risk management, which she conducts across the country. Jean has also successfully argued three matters before the Nevada Supreme Court. The first involved Nevadas adoption of the economic loss doctrine. The second involved Nevadas strict enforcement of the certificate of merit statute protecting design professionals. The third involved Nevadas adoption of the doctrine obstacle preemption, which bars owners claims for indemnity for ADA and FHA violations.
Jim V. Vitale, is an architect with over four decades of diversified public and private sector experience as a DSA Senior Architect-Access Compliance; an adjunct professor in the Construction Technology Department at Mt San Antonio College, a lecturer, curriculum development specialist, Accessibility SME subject matter expert to the state architect for CASp program implementation, a CASp Certified Access Specialist, DSA Academy instructor, a Registered Construction Inspector and an expert witness in State and Federal courts.
