Arbitration once was seen in the construction industry as a method of dispute resolution superior to all others for its low cost, speed, and expert decision makers. In recent times, it is seen by many as expensive, slow, unfair, and, yes, arbitrary. It is disfavored by many architects and engineers and their carriers. What went wrong? This seminar will discuss the characteristics of arbitration and the laws and rules that govern its practice that have led to its decline in design professional liability disputes.
